Terms of Service

1. Acceptance of Terms

By accessing or using AccessGuard, you agree to be bound by these Terms. If you do not agree, you may not use the service.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use AccessGuard. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

AccessGuard provides:

• Web accessibility scanning: Automated analysis of web pages for WCAG compliance issues
• AI-powered fix suggestions: Code recommendations to resolve accessibility issues
• Alt text generation: AI-generated alternative text for images
• Team collaboration: Shared workspaces for organizations
• Reporting: Export of scan results in various formats

3. Account Terms

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person may not maintain more than one free account
• You are responsible for all activity that occurs under your account

4. Subscriptions & Billing

Free Tier

Every account starts with 3 free credits, 1 site, and 1 team member. No credit card is required.

Paid Subscriptions

• Subscriptions are billed monthly in advance
• Subscription credits reset at the beginning of each billing cycle
• Unused subscription credits do not roll over

Credit Packs

• Credit packs are one-time purchases
• Credit pack credits do not expire
• Credit packs are non-refundable

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. After that, your account will revert to the free tier.

5. Acceptable Use

You agree to use AccessGuard only for lawful purposes. You must not:

• Scan without authorization: You must have permission to scan any website you analyze
• Circumvent limits: Attempt to bypass usage limits, rate limiting, or access controls
• Reverse engineer: Decompile, disassemble, or reverse engineer the service
• Resell the service: Provide AccessGuard functionality to third parties without authorization
• Interfere with service: Disrupt or burden our infrastructure
• Violate laws: Use the service in violation of any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

Our Ownership

AccessGuard, including its software, design, features, and documentation, is owned by Valerius. All rights not expressly granted are reserved.

Your Content

You retain ownership of your scan results and any data you upload. By using the service, you grant us a limited license to process your content as necessary to provide the service.

AI-Generated Content

You may use AI-generated suggestions and alt text in your projects. We do not claim ownership of AI outputs generated from your content.

7. AI Disclaimer

• AI suggestions are generated algorithmically and may contain errors
• You are responsible for reviewing and validating any AI-generated code before implementation
• Using AccessGuard does not ensure compliance with accessibility laws or standards
• We recommend professional accessibility audits for legal compliance

8. Limitation of Liability

To the maximum extent permitted by law:

• AccessGuard is provided "as is" without warranties of any kind
• We are not liable for any compliance outcomes or legal claims related to accessibility
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the fees you paid in the 12 months preceding the claim

9. Indemnification

You agree to indemnify and hold harmless Valerius, its officers, directors, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from:

• Scanning websites without proper authorization
• Your violation of these Terms
• Your violation of any third-party rights
• Your use of the service

10. Termination

By You

You may delete your account at any time from your account settings. Upon deletion, your data will be permanently removed within 30 days.

By Us

We may suspend or terminate your account if you violate these Terms or engage in abusive behavior. We will provide notice when possible, but reserve the right to act immediately for serious violations.

11. Governing Law

These Terms are governed by the laws of Bosnia and Herzegovina. Any disputes shall be resolved in the courts of Bosnia and Herzegovina.

Notwithstanding the above:

• EU users: Your rights under the General Data Protection Regulation (GDPR) apply regardless of jurisdiction
• California users: Your rights under the California Consumer Privacy Act (CCPA) apply regardless of jurisdiction

12. Changes to Terms

We may modify these Terms from time to time. For material changes, we will provide at least 30 days notice via email before the changes take effect. Continued use of AccessGuard after changes become effective constitutes acceptance of the new Terms.
